PERFORMA CAPITAL holds and develops digital assets – software platforms, products and the intellectual property in them – and grants licenses to them or sells them. The specific rights, fees, terms and service levels are set out in the individual license or purchase agreement. These Terms apply to this website only. Our licensing and sales are directed at businesses, not at consumers.
2. No Offer, No Online Shop
The content of this website describes our portfolio and is not an offer, a binding quotation or a warranty of availability. This website is not an online shop: it has no basket, no checkout and no payment function, and nothing can be ordered or paid for through it. An inquiry creates no entitlement to a license or a purchase, and no agreement comes about until it is concluded in writing between the parties.
3. Licenses and Digital Assets
No use, license or transfer of an asset is granted by this website or by any correspondence relating to it. Every license is granted under the written agreement covering it, which alone defines its scope, duration, exclusivity and permitted use.
