These Terms of Service govern your use of the PERFORMA.CAPITAL website. PERFORMA.CAPITAL grows the value of digital assets and business models, works with business networks to take them to market, and sells digital businesses that have proven themselves; it does not provide services to clients. Rights to a specific asset or business arise solely from a written agreement, which prevails over these Terms.
1. Scope
PERFORMA.CAPITAL holds and develops digital assets and business models – software platforms, products and the intellectual property in them – grows their value, and sells the digital businesses built on them. The specific rights, consideration, terms and undertakings are set out in the individual written agreement. These Terms apply to this website only. We deal with businesses, not with consumers.
2. No Offer, No Online Shop
The content of this website describes our portfolio and is not an offer, a binding quotation or a warranty of availability. This website is not an online shop: it has no basket, no checkout and no payment function, and nothing can be ordered or paid for through it. An inquiry creates no entitlement to a partnership or a purchase, and no agreement comes about until it is concluded in writing between the parties.
3. Digital Assets and Business Models
No use, right or transfer of an asset or business is granted by this website or by any correspondence relating to it. Every transfer is made under the written agreement covering it, which alone defines its scope, the rights transferred and the permitted use.

"Digital assets" here means software, platforms and the intellectual property in them, not cryptocurrencies, tokens or securities.
